Before the planned notarial act, we suggest contacting the notary to determine the amount and type of fees associated with the intended notarial act, which may include, depending on the type of notarial act, taxes, court fees, and the notary’s remuneration.

The notary is responsible for collecting and remitting the inheritance and gift tax as well as the tax on civil law transactions for actions performed in the form of a notarial deed. This means that in connection with the performance of the notarial act, the notary collects and pays the due taxes to the appropriate tax office.
In connection with activities in the form of a notarial deed that result in the necessity to file an application for entry in the land and mortgage register, the applicant bears the cost of the relevant court fee.

The amount of the notary’s remuneration is determined individually with the client.
For the notarial acts performed, the notary is entitled to remuneration determined based on an agreement with the parties to the act, not exceeding the maximum rates of notarial fees applicable to the given act, as specified in detail in the Regulation of the Minister of Justice of June 28, 2004, on the maximum rates of notarial fees.
If the party to the notarial act is unable to pay the notary’s requested remuneration without detriment to the necessary maintenance for themselves and their family, they may apply to the district court appropriate to their place of residence for a full or partial exemption from paying this remuneration. This provision also applies to legal entities that demonstrate they do not have sufficient funds to pay the notary’s requested remuneration. The court, upon determining that the need for the notarial act exists, grants the application and appoints a notary to perform the requested notarial act.
